These Terms and Conditions ("Terms") govern your use of holadeli.app, operated by Borderland Munoz Ventures LLC ("holadeli," "we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Service Description

holadeli is a food ordering platform that allows customers to place orders 24 hours in advance for pickup at designated locations. We prepare and deliver food to specific pickup points on scheduled days and times.

2. Account and Phone Verification

To place an order, you must provide a valid U.S. mobile phone number. We will send you a one-time verification code via SMS to confirm your identity. By entering your phone number, you confirm that you are the owner or authorized user of that number and that you consent to receive SMS messages from holadeli.

3. SMS Messaging Terms

    By signing up for holadeli, you consent to receive SMS messages including account verification codes and order-related notifications. Below are the key details of our SMS program:

    Program name: holadeli Order Notifications
Message frequency: Message frequency varies. You will receive an SMS each time you sign in (verification code) and may receive messages related to your orders.
Message and data rates may apply. Contact your wireless carrier for details about your plan.
To opt out: Text STOP to any message from holadeli. You will receive a confirmation and no further messages.

Supported carriers: Major U.S. carriers are supported. T-Mobile is not liable for delayed or undelivered messages.

  

You may opt out of SMS messages at any time by texting STOP. Opting out of SMS will prevent you from signing in to the service, as phone verification is required.

4. Orders and Payment

All orders are placed through the holadeli app at least 24 hours before the scheduled pickup. By placing an order, you agree to the following:

Orders are confirmed once submitted and may not be modified after the daily cutoff time.
Prices are displayed per item and may vary by pickup location.
Payment can be made in cash at the time of pickup or via card through the app.
We reserve the right to cancel orders if we are unable to fulfill them, in which case you will not be charged.

5. Pickup and Availability

Orders are available for pickup at the location and time you selected. We are not responsible for orders not picked up at the scheduled time. Menu items and pickup locations are subject to change and availability.

6. User Responsibilities

You agree to:

Provide accurate and complete information when using the service
Use the service only for lawful purposes
Not attempt to interfere with or disrupt the service
Not impersonate another person or use someone else's phone number

7. Intellectual Property

All content on holadeli.app, including the name, logo, design, and software, is the property of Borderland Munoz Ventures LLC and is protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the service without our written permission.

8. Limitation of Liability

holadeli is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Borderland Munoz Ventures LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to food quality issues, missed pickups, or service interruptions.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the service at any time without notice. We may also update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.
